Independent Contractor Policy & Notice

All registered cleaners are bound by the information contained on this document as clear evidence that you understand the position you are seeking is legally classified as an Independent Contractor. If while under contract with us, you perform in any way that is contrary to this, it will be considered a breach of your Independent Contractor Agreement and our business relationship will be terminated immediately.

 

Applications are considered for all independent contractors, and contractors are treated during the agreement, without regard to race, color, religion, sex, national origin, age, disability, or any other prohibited basis of discrimination as provided under applicable state and federal law.

 

1. Completing Job Assignment

It is up to the client to set a day and time when they would like the assignment to be completed. Elegant Empire's booking staff will relay that information to you in a timely manner so that you can either accept or reject an assignment. We do not set the day or time, but we may suggest it based on the availability of affiliate maids.

 

WE strongly recommend that you show up on time if you expect repeat assignments as recommended by clients that make reservation on our site. Some clients that have monthly cleaning contracts prefer consistency. So if you are not to the standards of a client, we will refer the assignment to another contractor.

 

Remenber, the more efficient you are at cleaning, the more you will get paid per hour worked.

 

2. Training

Our business is licensed as on online platform used to connect independent professional cleaning service providers with users. Elegant Empire is an online marketing venue and is under the control of Global Marketing Entrepreneurs Corp. We focus on website marketing to help small businesses, professionals and independent contractor’s increase revenue.

 

Therefore, we do not provide any training. We may suggest websites where you can get information about cleaning procedures, but do not provide any hands on training. As a good business practice, we may ask you general questions about the industry just to be sure you have the basic knowledge to meet the demands of the general public. The only training we may provide is how to access or website and any pages that we may recommend you look through every now and then.

 

 

3. Supplies and Equipment

We do not supply you with free cleaning supplies or equipment; however, if you lack the cleaning supplies to get started we will assist you during your 30 - 60 days on probation. Please consult a qualified tax professional so you can keep track of the cost of performing cleaning assignments for tax deduction purposes.

 

4. Independent Contractor Status

You will need to provide proof that you are a legal business; Corporation, Partnership, D.B.A (even if it doing business under your own name). Unlike traditional cleaning companies, we are okay if you perform work for your own customers when not doing sub contracted work through us. If you do not have a current business tax certificate in the area/s in which you will be performing cleaning assignments, you will need one BEFORE we offer any sub-contractor work for you in that specific area. If you need assistance with filling out any of the form required to operate legally as an Independent Contractor, we may assist you with that.

 

5. Business Relationship

The only ongoing business relationship you will have with us is spelled out in your sub-contractor agreement. Regardless of how many registered cleaners we have now or in the future, we do not require you to attend any planned meetings or gatherings held by the company. We strongly value freedom and the proof is in the way we operate. To view a detailed Independent Contractor Agreement, which is part of this notice, please use this space to enter your email. 6. Sub –contractors

All work you perform is under the name of your entity; D.B.A, Corporation, Partnership, LLC. All invoices given to us for work completed needs to reflect that. If we contract you for a particular assignment and for whatever reason you need additional help, you may hire an assistant, Although you may hire your own employees to help you perform the work, your affiliate manager will need to see proof of a number of items from them; proof of right to work in the United States, recent copy of documentation they are under your license, insurance, and surety bond.

 

7. Commission and Pay

You will be given an opportunity to negotiate and set the minimum amount you are willing to charge for specific jobs. If it is higher than what current market demands justify we may not be able to offer you any contract work. If the rates YOU DETERMINE are within the boundaries set by current market demands and reflected on our site, we may consider you for future contract work.

 

Furthermore, we do not determine the amount clients are willing to pay for any specific service. We are constantly making adjustments to listed prices and charge whatever current market demands indicate. Clients do business with us because our network is supported by experienced and  licensed independent cleaning professional that offer services at a great value.

 

Most assignments you are contracted to do are paid by the project. Please refer to your sub-contractor agreement for details. We will pay you 60% commission of the total gross paid for by our clients for any job.  When you are not hired on a time contract, you will be paid based on the square footage of the property. When converted to an hourly rate you should expect your earnings to be anywhere from $14 – $20 per hour of work. If you finish faster, you will earn more per amount of time spent.

 

8. IRS Form 1099

Any Independent Contractor that earns $600 or more during any calendar year will be issues a 1099 form for tax reporting purposes. If you perform cleaning assignments in more than one city, we recommend you keep track of the earnings of each city.

 

9. Work Schedule

You are open make yourself available for contracts for whatever times suit your needs. We do not offer full-time work and you are not required to work any specific hours. Clients reserve cleaning assignments based on their needs. We will suggest what times any number of registered cleaners may be available, but we do not dictate what assignments you take. Once an assignment has been booked, we merely relay that information to you about 48 hours prior to the date.  If you make yourself available for work during those times you may take an assignment, if not we will relay the assignment to another contractor.

 

10. Non-Compete Agreement

As an independent contractor you do not sign non-compete agreement. However, you need to understand that all client contracts you are offered to complete assignments have an exclusive contractual relationship with Elegant Empire. So for a period of 1 full year after the last completed assignment of any particular client, neither you nor the client may engage in any cleaning contracts without compensation to us. If it is later found that payments were made to you during the 1 year period, we will seek payment according to current pay scales for the entire period in question.

 

In addition, we do not offer any full-time cleaning positions. The volume of work in the cleaning industry is sporadic throughout the year. That is why you may perform cleaning services to the general public so long as it is not in violation of our Independent Contractor Agreement or client Service Contract Policy.

 

11. Reports

We do not require you to produce any reports to us. We do recommend that you keep track of the date, amount earned, and the city of each completed assignment. This will be necessary when filing your taxes. Just remember to supply us with an invoice for any work completed so we can cross reference it to our documents and make any necessary corrections before we pay you for your services.

 

12. Length of Business Relationship

The beauty about being an independent contractor with us is that you cannot be fired or discharged by Elegant Empire, unless a contractual obligation has been broken. Please review our detailed Independent Contractor Agreement that is found online. For example; soliciting work from clients that are currently under contract through us, not meeting the legal requirements to operate as an independent contractor, breach of our independent contractor agreement.

 

13. Contractual Obligations

As subcontractors you are bonded by a contractual obligation to complete every cleaning assignment. In addition you are responsible for delivering your work directly to your clients, and also have the primary responsibility and liability for the work. If clients are consistently unhappy with your workmanship, or  if you decide to not take any further assignments from us the following two things will happen.

a. Any clients assigned to you with long-term contracts will be reassigned by Elegant Empire to another contractor. We are the legal agent of every client assigned to you for a period of up to 1 year after the last cleaning assignment

b.Our Independent Contractor Agreement will be null.

 

14. Release of Liability

I also hereby release from liability Elegant Empire and its representatives for seeking, gathering, and using such information to make decisions concerning my status as an independent contractor for Elegant Empire and all other persons or organizations for providing such information.

 

THIS IS NOT AN APPLICATION FOR EMPLOYMENT. I understand and agree that if this application is accepted, my status will be that of an independent contractor and as such, I will be solely responsible for all tax liabilities pertaining to monies received in the course of services I perform.

 

If I am retained by Elegant Empire as an independent contractor I will:

• not be entitled to workers compensation benefits.

• not be entitled to unemployment insurance benefits unless unemployment coverage is provided by me or some other entity.

• be obligated to pay federal and state income tax on any moneys paid pursuant to the contract relationship.

• may be required to provide professional and liability insurance.

 

I represent and warrant that I have read and fully understand the foregoing, and that I seek to become an independent contractor under these conditions.

 

15. Online Applicants

Furthermore, I certify that the facts set forth in this application are true, complete, and correct to the best of my knowledge. I understand that any misrepresentations, falsifications, or omissions on this application can be grounds for immediate denial of my appointment or removal from consideration or, if I have entered into a contract with this company, for immediate termination of that contract. I authorize Elegant Empire to make any necessary inquiries and investigations into my education, references, or employment history. I further authorize, unless otherwise indicated on this application, the release of my information to Elegant Empire by any of the schools, services, or employers listed on this application.
